1. About these terms

These terms govern your use of this website and, where noted, our provision of security services. Specific engagements are governed by the written service agreement and quote issued to you, which prevails over these terms to the extent of any inconsistency.

2. Website content

Information on this website is provided in good faith and for general guidance only. Response times, ratios and recommendations described here are indicative and depend on your site, the time of day and current operational demand. Nothing on this website constitutes a binding offer or legal advice.

3. Quotes and engagement

• Quotes are valid for 30 days from the date of issue unless stated otherwise.
• Rates quoted are exclusive of GST unless expressly stated.
• Public holiday and penalty rates are disclosed within the quote and apply as noted.
• A minimum engagement of four hours applies to guarding shifts, in line with the applicable award.

4. Cancellations

Shifts cancelled with fewer than 24 hours notice may be charged at the full rostered rate, since officers have already been rostered and, in many cases, cannot be redeployed. Ongoing contracts may be terminated in accordance with the notice period set out in your service agreement.

5. Our obligations

We will supply appropriately licensed officers, maintain the insurances described in your agreement, provide the reporting specified, and comply with the Private Security Act 2004 (Vic) and all other applicable laws.

6. Your obligations

• Provide safe access to the site and disclose known hazards
• Provide accurate emergency and escalation contacts
• Provide amenities and safe rest facilities for officers on long shifts
• Pay invoices within the agreed terms

7. Limitation of liability

Security services reduce risk; they cannot eliminate it. To the maximum extent permitted by law, and subject to the Australian Consumer Law, our liability for any claim is limited to the resupply of the services or the cost of having them resupplied. Nothing in these terms excludes rights that cannot lawfully be excluded.

8. Confidentiality

Each party will keep the other party’s confidential information secure and use it only for the purposes of the engagement. Our officers are bound by confidentiality obligations in their contracts of employment.

9. Intellectual property

All content on this website, including text, graphics, logos and layout, is owned by Fortress Protection Services and may not be reproduced without written permission.

10. Governing law

These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that State.
